This sidewalk shed collapsed during a facade renovation of a high rise building. The shed, which was erected by another company prior to the start of the work, had a sign of approval by the NYC Department of Buildings.
The renovation contractor was issued two Notices of Violation by the Environmental Control Board, regarding overloading and failure to safeguard public and property.
The failure investigation report, prepared by Dr. Danay on behalf of the renovation contractor while with a forensic engineering firm in New York City, proved that the accident was not caused by any negligence attributable to the client. The judge ruled in favour of the renovation contractor.
